1208052 crane 135x100 City of Moose Jaw Reimbursed It has been one year since the multiplex lawsuit was heard by the local Court of Queen’s Bench. The City of Moose Jaw has received $6,990 in legal fee reimbursement from the appellants who lose their case.

In the written decision, made on December 24th, 2008, Saskatchewan Court of Appeal Judges Nicholas Sherstobitoff, Georgina Jackson and Robert Richardson confirmed the August 26th decision by Court of Queen’s Bench Justice Guy Chicoine and ruled in the favour of the City of Moose Jaw.

The money reimbursed is only a small portion of the several tens of thousands of dollars the city actually spent on legal fees.

The controversy which lead to last year’s multiplex lawsuit surrounded a 2006 referendum question stating: “That the City of Moose Jaw re-affirm its financial commitment of $15 million towards the construction of a multiplex facility, consisting of a stadium style hockey rink attached with a curling rink, at an estimated cost of $36.3 million as envisioned in the business plan dated Nov. 2005 from Nustadia Recreation Inc.”

In June 2008, the council had approved $61.3 million for a multiplex project with the city having a financial commitment of approximately $19.5 million above the referendum figure.

It is great that this project is able to move forward without any more legal fees or issue, and money returned for the trouble they went through. It may not cover all the costs, but now that it is over and done with, we can look back to this issue as a small bump in the road.
